  • Changia takes your data privacy as its first priority. Changia is committed to maintaining the privacy of the personal information that our users provide to us. This policy explains our information practices and how we process your information to provide our services. By using Changia you acknowledge that the terms and conditions in this Privacy Policy will apply to you, as well as to any information that you provide us. Kindly read through this Privacy Policy to get acquainted with our practices.
  • Information We Collect, and How We Use It

  • Changia collects some of your personal information to provide, support, improve, and market the changia service. Some of the ways that we may collect personal information include information that you provide us directly; information about you that we automatically collect from log data, IP addresses, and aggregated user data; cookies; information that you give us about your friends; and your chat histories.
  • Types of Personal Information we collect

  • when you registering an account. You provide us with your “mobile phone number” as your account identifier, you will need to provide it to enable Changia to create your changia account. You also have the option of providing your full name for identifying your profile

  • Content that you share with public and other changia users on the chats, including message, photos, and videos; as well as phone book contact list of members in your chat groups
  • Information you give us during any support and feedback communications via email, postal mail or chat.
  • Payment Information, Amount, Name, Ref number, timestamp, Tel/ acc number, which we receive from third parties associated with your changia account which may be needed to make your account statement, and statements of any group you may have contributed .
  • Any Payment information you may send to us to enable us to initiate payment processing i.e. M-Pesa and other authorized third parties
  • How we use the data we collect from you?

  • To enable you to access and use changia Service, including to manage user information and accounts.
  • To customize your changia experience
  • To conduct changia usage research and development
  • To test and introduce new features and products, and to improve and monitor the effectiveness of changia Service.
  • To contact you for feedback and support
  • To enforce our Terms of Service
  • For any other purposes that we specifically communicate to you when we collect that information with your consent, or for which we have a legitimate interest, such as direct marketing, individual or market research, or anti-fraud protection; and To market our products and services and to provide you with materials about offers, products, and Services that may be of interest, including new content or Services, including tailoring content, advertisements, and offers, and to notify you of offers, products and services that may be of interest to you, for other purposes disclosed at the time that you provide your information, or otherwise with your consent
  • Other things you should know:

  • We may remove/suspend/delete, at our sole discretion, any information that you provide when you register for or while using the Service (such as names, telephone ,email, profile pictures, names, chat, public post etc.), if we believe it is inappropriate or violates any of our terms and policies but not limited to, our Terms of Service.
  • Finger print and Local PIN

  • When you use features that add security to your account when using the Service, we allow you to create a local PIN and can collect your fingerprint as a security measure.
  • How do we use it?

  • We use the fingerprint or PIN we collect to your account when using the Service.
  • Fingerprint information remains on your device and is not uploaded to our servers
  • We do not share the fingerprints and PIN information with third parties.
  • Payment information

  • If you choose to make payment or contribute to a group through changia Services (e.g. for group fund raising services), we process your payments through a third-party application, such as the M-Pesa, Pesa-Link, Banks etc.
  • How do we use it?

  • We and the said third-party payment processor may collect certain financial information from you to process a payment on our behalf, including your Telephone number, name, email address, and other billing information.
  • Location Information

  • When you use our Mobile App, we may collect and store information about your location by converting your IP address into a rough geo-location or by accessing your mobile device’s GPS coordinates or coarse location if you enable location services on your device.
  • How do we use it?

  • To improve and personalize our Services and to target advertisements that may be more relevant to you.
  • Your Chat History

  • We will collect, save and store all information contained in your changia chat history for up to 90 days, including your photos, voice messages, videos, sticker and missed calls. You can delete your changia chat history from your mobile app at any time by going to profile of specific chat and use the icon “Clear Chat”
  • How do we use it?

  • To allow you to access your chat history, photos, videos and missed calls for your own purposes.
  • Sharing Your Information- Information we share

  • In addition to using your information for the purposes described above, we may share your information with parties other than Changia or its users (the “Third Parties”). In some cases we may request your permission before we share that information, but we reserve the right to share your information with Third Parties without prior notification or without soliciting additional permission: We discuss below situations where we may share your information without requesting your further permission:
  • We share certain information about you (including information which could be used to personally identify you) with the companies we engage to facilitate our Service, perform Service-related functions, and/or provide the Service on our behalf, such as Internet Service Providers and hosting service providers. We require these companies to maintain your information in confidence, and they are prohibited from using your information in any way other than performing services for or on behalf of changia or to comply with applicable legal requirements
  • We may disclose your information (including information which could be used to personally identify you) when we have a good faith belief that disclosure is necessary: (i) to respond to subpoenas, court orders, or other compulsory legal process; (ii) to protect our property rights and investigate and defend against legal claims (iii) to enforce or apply our Privacy Policy, our Terms of Service or our other policies or agreements; (iv) when we believe disclosure is necessary to protect others from death or serious bodily injury; (v) to collect amounts owed to changia; (vi) to respond to your requests; and (vii) as otherwise required by law.
  • Opting out of Receiving Communications

  • Transfer your information in the event that changia is involved in a merger, acquisition, divestiture, consolidation, reorganization, asset sale, or bankruptcy
  • You have the right to opt out of certain uses and disclosures of your personal information.
  • Email and phone communications

  • If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt-out of receiving future emails. We will process your request within a reasonable time after receipt. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding changia and our Services and you will not be able to opt out of those communications (e.g., communications regarding updates to our Terms or this Privacy Policy).
  • Mobile devices

  • Changia may occasionally send you push notifications through our mobile applications. You may at any time opt-out from receiving these types of communications by changing the settings on your mobile device. We may also collect location-based information if you use our mobile applications. You may opt-out of this collection by changing the settings on your mobile device.
  • Data Retention

  • Changia retains the personal information we receive for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
  • Security

  • Your Changia account, and registration information are protected so that only you can access your account. All personally identifiable information that we collect about you is stored in limited-access servers. The Service has security measures in place to protect against the loss and misuse of the information which is under our control. While we are committed to implementing reasonable and appropriate safeguards to protect your information against foreseeable risks, no computer system or information can ever be fully protected against any possible risk, and we cannot guarantee that unauthorized third parties will not be able to circumvent those safeguards, or access and/or use your personal information for improper purposes.
  • By using the Service or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service.   • The Services are not directed to children under 18 years of age, and changia does not knowingly collect Personally Identifiable Information from children under 18 years of age. If you learn that your child has provided us with personal information without your consent, alert us at privacy@changia.co.ke for deletion. If we learn that we have collected any personal information from children under 18 years, we will promptly take steps to delete such information and terminate the child’s account without any other prior notice

TERMS AND CONDITIONS OF CHANGIA APP

DEFINITIONS.

  • “Changia” means contribute in Swahili. A user can contribute either financially or socially through the platform.
  • “Terms and conditions” means the legal agreements between a service provider and a person who wants to use that service. The person must agree to abide by the terms of service in order to use the offered service.
  • “Privacy policy” is a statement or a legal document that discloses some or all of the ways a party gathers, uses, discloses, and manages a customer or client's data
  • “Indemnity” means security against or exemption from legal liability for one's actions.
  • “Subscriber” means a person who has arranged to receive or access a service
  • “Cookies” is a small amount of data generated by a website and saved by your web browser. Its purpose is to remember information about you, similar to a preference file created by a software application.
  • “Web beacons” is one of various techniques used on web pages and email, to unobtrusively allow checking that a user has accessed some content.
  • Pixel tags are small blocks of code on a webpage that allow websites to do things like read and place cookies.

  • “Fees” means the Transaction Fees and other charges payable under this Agreement for the Changia App.
  • “Mobile Phone” means your mobile phone handset or mobile device.
  • “Payments” means money or monies paid to your account as a contribution.
  • A “Social Networking Service’’ (also social networking site or social media) is an online platform which people use to build social networks or social relationship with other people who share similar personal or career interests, activities, backgrounds or real-life connections.
  • USE OF CONTENT

    The use of this mobile application is subject to the following terms of use:

    • The content of the pages of this mobile App, which is subject to change without notice, is for your general information and use only. You agree that you are only permitted to use this mobile App as expressly set out in these terms and conditions or otherwise on the App.
    • You must be at least 18 years of age to use this App. By using this App and by agreeing to these Terms and Conditions you warrant and represent that you are at least 18 years of age.
    • The information on this App is periodically updated and you should therefore check the App regularly to ensure that you have the latest information.
    • This App contains material and content which is owned by Changia. Such material and content includes, but is not limited to, the design, layout, look, appearance and graphics and is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Nothing in these terms and conditions shall be construed as conferring any license or other transfer of rights to you of any intellectual property or other proprietary rights of Changia App or any third party and any reproduction and redistribution of the material and/or content of this App is prohibited other than in accordance with the internet copyright notice below, forming an integral part of these terms and conditions.
    • You may not remove, change or obscure in any way anything on this App, or otherwise use any material obtained whilst using the App, except as expressly set out in these terms and conditions.
    • You may not create a link to this App from another App, website or document without Changia App prior written consent.
    • By downloading and activating this App you agree to the terms and conditions of this Application.

    GENERAL

    • Your use of this App and any dispute arising out of such use of the App is subject to the laws & governance of Kenya.
    • If any provision in these terms and conditions is, by any court of competent jurisdiction, determined to be illegal or unenforceable, such provision shall be deemed to have been deleted without in any way affecting the remaining provisions of these terms and conditions.
    • Changia App failure to exercise any particular right or provision of these terms and conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Changia App in writing.
    • Changia App have all absolute rights/ sole discretion to deregister/remove you from the service without prior if they discover any conduct contrary to the said terms and conditions or when you infringe in other people’s rights.
    • We can remove any content or information if we believe that it violates these terms and conditions or our policies without notice.
    • By subscribing to this App you give full rights to use the information you give us like email addresses, phone numbers and any other contact details to reach you and share any information we feel necessary for your use.
    • Changia App will host the subscribers’ data in their servers where the clients can access all their information at any given time.
    • The App services are charged on a commission basis of all the contributions made.
    • Changia services will be charged a commission of 1% of the total contributions made, this may vary from time to time on Changia’s own discretion
    • Changia App have all the absolute right without consultations with the users to adjust the commission fees and any other fees at any time.
    • All contributions will be accessible and withdrawable by the admin of the group.
    • Transaction charges will apply as per the mobile operating network used by the subscriber or any other payment channel used for transacting within Changia App. Changia app has no control over these charges (3rd party transactional charges)
    • Changia solutions doesn’t warrantee that the app service will be 100% stable, bugs maybe experienced as described in these terms and conditions but Changia App will debug any technical issue within the shortest time possible
    • Termination of this agreement shall not relieve you or your organization from any payments or fines that may have arisen prior to the termination of this contract

    SOCIAL NETWORKING SERVICES

    Changia App is not responsible for the accuracy, availability or reliability of any information, content, goods, data, opinions, advice or statements made available in connection with Social Networking Services. As such, Changia is not liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Social Networking Services. Changia enables these features merely as a convenience and the integration or inclusion of such features does not imply an endorsement or recommendation.

    LEGAL RESTRICTIONS

    Changia App shall not be used by any person or entity in any jurisdiction where the direction or use of such a product is prohibited or would be contrary to applicable laws, rules or regulations of any governmental authority or regulatory organization.

    MISLEADING, OFFENSIVE AND INAPPROPRIATE CONTENT

    • Changia App does not endorse any product, service, political party, viewpoint or opinion. We reserve the right, without any liability or claim howsoever arising, to monitor content on our systems and remove any that in our sole opinion and discretion we find misleading, offensive, or otherwise inappropriate.
    • The user is solely responsible for all transmitted material and/or communication which may be classified as defamatory, illegal, inappropriate or other intellectual property laws and you will indemnify and keep us indemnified against all claims made against us in respect thereof and any liability or expenses incurred or suffered by us as a result thereof.
    • You must not use Changia App to commit any offence.

    INDEMNITY

    Unauthorized use of this App or non-compliance with the present terms and conditions may give rise to a claim for damages and/or be a criminal offense. You hereby agree to fully indemnify and to hold harmless Changia App from and against any claim brought by a third party resulting from your use of this Mobile App, and in respect of all losses, costs, actions, damages, expenses or liabilities whatsoever suffered or incurred directly or indirectly by Changia App in consequence of such use or your breach or non-compliance of the present terms and conditions, this is to all the App Users.

    DISCLAIMER

    • The information contained in this App is for general information purposes only and is provided by Changia App on an “as is” basis.
    • Your use of any information or materials on this App is entirely at your own risk, for which Changia App shall not be liable. While Changia App endeavors to keep the information up to date and correct, it shall be your own responsibility to ensure that any products, services or information available through this App meet your specific requirements and are suitable for your purposes.
    • Neither Changia App, nor any third parties, provides any warranty or guarantee, express or implied, as to the accuracy, timeliness, performance, completeness, availability or suitability with respect to this mobile App or the information and materials, such as products, services or related graphics, contained, found or offered on this App for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and you are, furthermore, fully aware that Changia App expressly excludes, to the fullest extent permitted by law, any legal liability or responsibility for any such inaccuracies or errors and that, hence, any reliance you place on such information is strictly at your own risk.
    • All trademarks reproduced in this App, which are not the property of, or licensed to Changia App, are acknowledged on this Application.
    • From time to time this App may also include links to other Applications and websites. These links are provided solely for your convenience to provide further information. They do not signify that Changia App endorses said Apps and website(s) and Changia App assumes no responsibility for the content of any such linked Apps or for any third party content otherwise included in this App.
    • In no event will Changia App be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this mobile Application.
    • Every effort is made to keep this mobile Application up and running smoothly and to secure the availability of Changia App. However, Changia App takes no responsibility, and will not be liable, for the application being temporarily unavailable due to technical issues beyond Changia App control and any required maintenance performed without prior notice causing temporary interference in the availability of the App, things beyond our control, including acts of god (for example, weather-related phenomena, fire, earthquake, hurricane, etc.), riot, strike, war, terrorism, government orders, server breakdowns and crashes etc.
    • Changia App shall not be liable for any special, indirect or consequential damages, whether in contract, negligence or tort, arising out of or in connection with your use of this mobile Application, or of the content therein.
    • Subscribers to this app should implement appropriate safeguards to secure their devices and to back-up their information stored on them.

    Changia App usage of your personal information is governed by Changia App Privacy Policy

    We will only collect and use your personal data as outlined in our terms and conditions and privacy policy. We will use your data to service your account and send you any information we feel is necessary for you regarding the services offered by the app. We won't sell your data or use it inappropriately. It’s our responsibility to protect against unauthorized access, destruction, use, or disclosure of your data.

    • Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date, in case you give false data Changia App has the absolute right to deregister you from the App service since that will be a sign of fraud or conning.
